Alfa Transimissions and waranties

Dear All,
I am a prospective Alfa owner looking at moving from an Audi A3 to a 159 tdim.
Test drove the near new Alfa this weekend, big spill of what looked and felt like sump oil
Alfa claim its transmission fluid as a result of crimped hose causing a tear, producing a leak, pooling in transmission cover which was then dumped because of the steep incline of driveway I had parked on.

Now I have no reason to doubt their advice, its just that the fluid looked like black sump oil, so if it was hydraulic fluid its colour would suggest the gearbox was overheating.They say its what their special synthetic transmission fluid looks like !!!!!!

Any thoughts or knowledge before I buy or return to teutonic order?
