Thanks for comments guys.  As the vendor I have the right to withdraw item from sale at any time.  An eBay purchaser is entering into a contract to buy once they bid.  Cheers,  Nick

This is the problem with ebay because if a vendor has a right to withdraw an item for sale, legally no bidder is ever under contract. A legal contract requires clear 'offer & acceptance' before it exists and hence ebay creates this problem by allowing vendors to withdraw an item for sale. ebay claim a bid is binding but legally, it will not hold in Australian courts.
